  2. This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us and our partners.
  3. By using our services, you consent to your information being processed by us in the manner described in this Privacy Policy.
  4. This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and the rules made thereunder.
  5. This Privacy Policy does not require any physical, electronic or digital signature.
  6. This Privacy Policy shall be deemed to be incorporated into the Terms and Conditions and shall be read in addition to the Terms and Conditions.

This Privacy Policy may be amended from time to time, to reflect any changes in the way we use personal data at JustAct, or for legal or regulatory reasons.

  1. In many instances, the information we collect may be “business contact information” (i.e. your name, position name or title, business telephone number, business address, business email address or similar information, not provided solely for personal purposes). JustAct will use reasonable efforts to observe the terms of this Privacy Policy in respect of business contact information. The protection of and respect for your information is important to us.


What information do we collect about you?


  1. JustAct receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.


We may collect and process the following information about you:


  1. Your name, mobile number, email ID, address, designation, and identity proof details.
  2. JustAct may record audio and video while using the Services for the purposes of conduct of its services in line with the requirements of the Arbitration & Conciliation Act 1996 and any amendments thereto, or any other applicable laws, rules and regulations, as applicable from time to time. JustAct is not responsible for how you use your recordings, or the recording features.
  3. Any correspondence between you and us.
How Do We Use Your Information?

We may use your information in the following ways:

  1. To provide our Services, including dispute resolution and platform services.
  2. To respond to you when you contact us and to deal with your requests and enquiries, and to provide you with information about our Services, activities or content;
  3. To carry out our obligations arising from any contracts entered into between you and us;
  4. To verify accounts and activity to ensure our Services are being used legally;
  5. To notify you about any changes in policies, procedures, rules and regulations at JustAct that may need such notification;
  6. For analytical purposes on data, in a duly redacted form so as to protect any personally identifiable information.
Information Sharing With Third Parties

Any information you upload to your profile and/or post on our website may be visible to our personnel and other users of our website.

We may disclose your information to third parties:

  1. Where partners help us in the administration or operation of our organisation (e.g. our hosting/back-up service providers, telephony providers and our IT service providers);
  2. Where we use third party providers in the provision of the Services to you;
  3. In order to enforce or in complying with our obligations under applicable laws, Rules and regulations, our Terms and Conditions, or other agreements;
  4. And if we are under a duty to disclose or share your personal information in order to comply with any legal or regulatory obligation.
How do we protect your information?

The security of your information is important to us. We maintain appropriate and reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks. However, the transmission of information via the internet and global telecommunications networks is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your personal information provided to us via the internet or other telecommunications networks, and any transmission is at your own risk.

We will hold your information for as long as is necessary for the purposes described in this Privacy Policy or in our Terms and Conditions, or for legal, regulatory or business purposes. Please also refer to Clause 14 with respect to Data Erasure.

Security

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

Jurisdiction

The terms of this policy shall be governed by Indian Laws and subject to Clause 12 above, the Courts in Chennai shall have jurisdiction over any dispute that arises regarding this Agreement.

Dispute Resolution

Any dispute over privacy is subject to this policy and the terms of use of this policy.


In case of a dispute arising, the Parties shall endeavour to resolve such dispute through mutual discussion in 30 days, failing which the parties hereby agree to resolve such a dispute through mediation, by a mediator to be jointly appointed by the Parties. Any disputes, differences, or claims which, may arise with respect to privacy out of this policy, and survive following the mediation undertaken by the Parties shall be referred to the decision of a sole arbitrator to be appointed by the mutual consent of the parties in accordance with and subject to the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall take place in Chennai, Tamil Nadu and the proceedings shall be in English. The arbitral award shall be final and binding on the parties. The policy and its terms of use shall remain in full force and effect pending the award of such an arbitration proceeding.

Treatment of Data Erasure requests

Defining Data Erasure


  1. Data erasure is the process of erasing personally identifiable data, captured electronically on the JustAct platform and stored in related servers and cloud infrastructure.


When can a Data Erasure request be made


Data subjects can exercise the right to be forgotten under the following cases:


  1. Where Personally Identifiable Data is no longer necessary for the purpose for which it was originally collected or processed by JustAct
  2. Where personally identifiable data is collected and processed without the consent of the data subject
  3. Where Data subject wants to withdraw their consent after registering on the platform but before creating a part(y)/(ies) and/ or registering / being part of any case on the JustAct platform


When can Data Erasure requests are not made


Data erasure requests may not be admissible under, but not limited to, the following circumstances: 


  1. To meet legal, police, any investigative agency and compliance requirements
  2. The “right of freedom and expression”
  3. For supporting legal claims
Processing of Data Erasure Requests.
  1. Where Data subject has already created/ is part of a case, such erasure requests will be processed only subject to and after the permission of all the other parties in the case
  2. Where the Data subject has already created a Party, deletion of the party will be processed only subject to and after the permission of all other parties and in all the cases that have the said Party. 
  3. Any deletion of case related data may be carried out only after a lapse of 12 months from the date of closure of the case, which closure may be either due to successful resolution or due to quitting/ abandonment of the case by any of the parties.
  4. At the same time, for the sake of clarity it is stated that JustAct retains the right to use any case data, minus the personally identifiable data for analytical and other purposes.
  5. When JustAct receives any request for deletion from the data subjects, personal data of the data subjects would be deleted within 30 days of such erasure request being made provided the request does not violate any requirements and is subject to fulfilment of all the clause(s) under this policy.
Notification of Erasure of Personal Data

JustAct shall be notifying the data subjects about the erasure of their personal data once the data subject’s personal data has been deleted.

Miscellaneous

Use of the JustAct platform and this policy and its terms of use are meant for only those individuals or organisations who are competent to enter into a contract under the provisions of the Indian Contract Act, 1872 and amendments thereof.

Updates to this policy

This Privacy Policy was last updated on 22nd December 2022. We will notify you of a new version of the policy if we make any material changes, on your email ID, if the same is registered with us. Do please keep your email ID updated, we will not be responsible for any non-delivery of emails on any account. We will also post an updated copy on our website. Please check our site periodically for updates.
